Woman's body brews alcohol; drunk driving charge dropped

Not everyone who is arrested for drink driving is charged or convicted of the crime, particularly when there's a good reason to dismiss the case. You may be able to have charges against you dropped or penalties lowered with the help of your attorney, too.

In this case, a charge was dropped because of an unusual disorder. The woman, arrested for driving under the influence of alcohol, has had her case dismissed after it was discovered that her body was naturally brewing food and drink into alcohol in her stomach. According to the news from Jan. 1, the woman blew a breathalyzer test over four times the legal limit just before Christmas, even though she claimed she had only four drinks in six hours.

For a woman of her size and weight, that many drinks should only have produced a blood alcohol concentration of 0.01 and 0.05. However, hers shot to close to 0.40. That level is extremely dangerous to humans, and few survive it. She was taken to the hospital, and there, her husband asked to have tests performed on her body. Many hours after her last drink, her blood alcohol concentration was still 0.30.

Without any alcohol, she somehow had a BAC twice the legal limit during a test at 9:15 a.m. At 6 p.m., she showed a BAC triple the limit. She showed no signs of intoxication until that evening, when her body reached 0.30 to 0.40.

To help eliminate this syndrome, the woman is being treated with anti-fungal medications. She's also on a yeast-free diet and unable to have alcohol or sugar. Since carbohydrates convert to sugar in the body, she's also on a low-carb diet.
