Marijuana: Defending yourself against drug charges in Colorado

Can you still get in trouble for using marijuana in Colorado, even though it's legal in the state? The facts indicate that you can, but you have a right to speak with your attorney and defend yourself if you're accused of drug charges.

There is still the potential to get in trouble with the law for using marijuana if you don't follow the rules of use. For instance, you need to be at least 21 to buy, use, or possess marijuana. Minors are still not able to take marijuana legally, and it can't be sold to anyone under the age of 21.

Medical marijuana card holders are legally able to self-grow marijuana or get it from a licensed retailer or medical facility. For consumers, only licensed retailers can sell marijuana to those age 21 or older.

Interestingly, even though marijuana is now legal, it's still illegal to use it in public or openly. If you're caught smoking it at a park, indoor-but-public location, or other venue, you can be accused of a drug crime and could face charges.

Since 2012, it's been legal to have up to an ounce of marijuana at any one time. Even though several people may be able to possess this amount legally, it's not legal to go to a coffee shop or social club where the main goal is to smoke marijuana together. These facilities are still illegal in the state, and violations of marijuana laws can lead to prison sentences.
